Our affiliate program is quick, easy, and free to join! Your benefits include 5%-10% commissions on sales from your referrals' purchases when they initiate their shopping session using your specially coded affiliate link (url). Just read the terms below, and then click on Affiliate Program to submit your information and join our Affiliate Program today. Simply signing up for the affiliate program binds you to the Affiliate Agreement.

After you join, you can access your Affiliate Account screen to find information regarding your account, as well as reports regarding your current sales.

What you do...

1. Create your new affiliate account.
2. Obtain a special link or banner that is uniquely associated with your account from your Affiliate Account Screen. (Samples provided in your account information screen.) Then place our link or banner on your website and use it in your email messages. This will allow you and others to reach our website via a link that associates the sale with you. We will properly credits the commission to you..
3. Earn 5% commissions when you or others initiate their shopping at Goswac.com through your special link or banner.
4. After your total commission has reached $100, contact us and we will upgrade your account to a “gold” account which will upgrade your commission rate to 10%.

What we do...

1. We will credit you with the proper commission on sales initiated from your link to Goswac.com.
2. Your sales and commissions are automatically tracked by our order entry system. You can view real-time totals on your affiliate account screen.
3. We send you a check once a month on payable commissions when they exceed $30 as specified below.

All commissions will be paid in $US and drawn on a US bank.

If a wholesale or distributor account customer also decides to become an affiliate, commissions will only be paid on their referrals' purchases, but not on the wholesale account customer's purchases.

Commissions are on sales before taxes and shipping charges. No commissions are paid on gift certificate sales, fraudulent orders, orders that are charged back or cancelled, or if items are returned for a refund. In such cases your commission will be voided and reversed on your account. Commissions on an order are payable beginning on the 30th day after an order's payment clears at our bank. Checks are mailed for payable commissions during the first week of each month when your account commissions have accrued to exceed $30.00.

An affiliate's account may be disabled and deleted following 6 months of inactivity, which is defined as no sales generated from the affiliate's link. If an inactive affiliate account is closed and there is at least a $1 balance in the account at that time, a check for the balance in the account will be sent to the affiliate. If the balance is below $1 at the time of closing of the account, that amount will be forfeited.

Gold Affiliate Status - Qualify for a permanent upgrade to 10% commissions and become a gold Affiliate. Nothing extra to add. Just request this upgrade when you meet a minimum qualifying level of sales/commissions of $100.

Non-profit organizations - We have a special fundraising opportunity for you; Car Clubs museums, Automovive associations, reunion groups, research sites etc. operating as "non for profit organization" will earn additional 10% commission. That's right- a total of 15-20% commission on each and every sale that comes with your affiliated code. Use your code on your web site, on flyers in the next reunion, or in your email campaign and newsletters.

Affiliate Agreement - Terms and Conditions.

(BEGIN) GOSWAC.COM Affiliate Agreement ---------------------------- AFFILIATE AGREEMENT This Affiliate Agreement is valid from the creation date (January 1st, 2004) forward. Affiliate Agreement terms and conditions located between the (BEGIN) and (END) tags in this page. 1. Goswac.com, Also Known As(AKA) Southwestautocare.com, AKA Goswac, AKA Southwest Auto Care, is a registered website owned by J & I Investments Inc, a company incorporated in and according to the law of the State of Arizona USA whose registered office is at 17054 south 54th street Chandler, Arizona 85226 U.S.A. Will be herein referred to as "Goswac.com" 2. "You" or "the Affiliate" will be known herein as "Affiliate" 3. "Retailer" or "Linked Web site", the Merchant company operating an affiliated online store via a Goswac.com service. 4. These terms of service may be updated at any time and it is the sole responsibility of the affiliate to check for updates to this agreement. The agreement can be found 24 hours a day, 7 days per week at http://www.goswac.com/affiliate.aspx. If the website cannot be accessed or you have no internet access, a copy of these terms of service can be mailed via USPS at no cost to you via the address listed on the websites contact page or in the Affiliate agreement section in this document. This agreement can also be faxed in place of USPS and it is your responsibility to retrieve it. It is your sole responsibility to periodically check these terms of service for changes or ammendments. The terms and conditions can always be found at the URL: http://www.goswac.com/affiliate.aspx or some relevant location on the Goswac.com website homepage. WHEREAS A. Goswac.com has developed and operates a service, which allows you to earn money by placing a link on your web site to one or several Retailer web sites, connected via Goswac.com B. In order to use the service you agree the creation of an affiliate account with Goswac.com is your acceptance of these terms of services. Accepting the conditions of this agreement, you become authorized as an "Affiliate". Please read this Agreement carefully. Your endorsement on any check issued by Goswac.com , either stamped or signed, is furthermore legal burden of proof to your signed acceptance of these terms of service. You are not allowed to use the service if you do not accept the provisions of this Agreement. C. You must be accepted by Goswac.com to whose Affiliate Program you would like to be registered before you can become an affiliate. You will be informed through Goswac.com's web site and/or throught email from Goswac.com when you have been accepted as an Affiliate. Now therefore, you hereto agree to the following binding terms of the agreement. 1. DEFINITIONS The following terms when used in this Agreement shall have the following meanings: 1.1. "Linked Web site" - means a Web site to which the Affiliate has placed a link on his web site and which is connected to an Affiliate Program registered at Goswac.com. 1.2. "Visitor" - means any person who clicks on a link placed on the Affiliate's web site and thereby is connected to a Linked Web site. 1.3. "Click" - means a click by a Visitor on a link on the Affiliate's web site serving a Linked Web site to the Visitor's browser. 1.4. "Lead" - means a Visitor who is connected to a Linked Web site by the Affiliate and who has completed a definite act at the Linked Web site, for example made a registration as a user. 1.5. "Transaction/sale" - means a Visitor who is connected to a Linked Web site by the Affiliate and who has completed an agreement to buy a product, service or anything else supplied on the Linked Web site. 1.6. "Traffic" - is a collective term for valid Clicks, Leads and Transactions/sales. 1.7. "Artificial Traffic" - is a collective term for invalid Clicks, Leads and Transactions, which may originate (for example and without limitation) from automatic openings, spiders, robots, requests in email or chat rooms, script generators, placing links on other web sites than informed and Clicks which are not generated by a browser, Clicks which are not preceded by an active act of a Visitor who wants to reach a certain web site. 1.8. "Affiliate Program" - is a program owned and operated by Goswac.com which the Affiliate can join. 1.9. Words denoting the masculine gender include the feminine and other genders and words denoting the singular number only shall include the plural and vice versa. 2. THE SERVICE 2.1. The Affiliate is allowed to place links on his web site to web sites which have an Affiliate Program registered at Goswac.com 2.2. Any Affiliate Program may be amended or terminated at any time. Information about the Affiliate Programs will be available on Goswac.com's web site, www.Goswac.com. The Affiliate must keep himself informed of any amendments of Affiliate Programs, in particular if a registered web site has terminated its Affiliate Program or changed the conditions for remuneration to Affiliates. The Affiliate must comply with the requirements of the Affiliate Program including in particular any stipulations as to the nature and content of the Affiliate's web site and the use of third party or other Affiliates trade marks and logos. 2.3. Goswac.com reserves the right to modify, amend, change or terminate Goswac.com's service. The Affiliate will be notified of all such changes by email or by an announcement on Goswac.com's web site. If the Affiliate does not accept the changes the Affiliate must immediately cease to use the service and delete all links to Linked Web sites, as well as all Images and other property of Goswac.com 3. OBLIGATIONS OF THE AFFILIATE 3.1. The Affiliate is solely responsible for his web site and its contents and shall ensure that they conform at all times to all applicable laws and regulations. 3.2. If the Affiliate is a natural person he must be at least 18 years of age. If the Affiliate has not reached the age of 18 a parent must give his consent to the registration to Goswac.com's service and the registration of an Affiliate below the age of 18 without parental consent will be ineffective. 3.3. The Affiliate warrants that the information furnished to Goswac.com about himself and his web site is correct, complete and sent in due order and that the information corresponds to actual facts. The Affiliate must notify Goswac.com immediately of any changes in the information by updating the information about him on Goswac.com's web site. 3.4. The Affiliate warrants either that the rights to all information and productions, including but not limited to images, on Goswac.com web site belong to Goswac.com, or that the owner of the rights to the information and productions on the Affiliate's web site has given his explicit permission to their publication there. The Affiliate also warrants that the information and productions on the Affiliate's web site do not infringe any rights of third parties, including intellectual property rights, and that such information and productions are not offensive, prohibited or questionable in any way. 3.5. The Affiliate must not in any way generate or contribute to generating Artificial Traffic to Linked Web sites. 3.6. The Affiliate must notify Goswac.com immediately of any known or suspected improper or wrongful use of the Affiliate's links to Goswac.com's web site and/or an Affiliate Program or of Goswac.com's service in any way whatsoever. 4. OBLIGATIONS OF GOSWAC.COM 4.1. Goswac.com undertakes to monitor and register the sales generated by the Affiliate's web site, in accordance with the service provided by Goswac.com. 4.2. Goswac.com will pay commission to the Affiliate within accordance to this agreement between the Affiliate and Goswac.com. Your endorsement on any check issued by Goswac.com, either stamped or signed, is furthermore legal burden of proof to your signed acceptance of these terms of service. 5. REMUNERATION 5.1. The conditions of remuneration for each Affiliate Program are published on Goswac.com's web site and shall apply at all times. 5.2. Subject to clause 5.3, payment of accumulated remuneration to the Affiliate shall be made monthly in arrears provided that the Affiliate has generated valid sales. Payment is made directly from Goswac.com 5.3. Payment of remuneration will only be made if two months prior to the payment date the Affiliate is due an amount of at least $30. An amount due of less than $30 will be accumulated to the next payment and will be included in the amount to be paid out at the next payment date, again provided that the minimum amount of at least $30 is due two months prior to that payment date. All payments are calculated upon the total sales generated up to the end of two months prior to the month of payment. Accumulated amounts do not accrue any interest. 5.4. Nothing in this Agreement shall create or be deemed to create, a partnership or relationship of employer and employee between Goswac.com and the Affiliate. 5.5. Payment to the Affiliate will be made to the Affiliate by a company check to the Affiliate. The Affiliate must specify to Goswac.com the name and address of the person to whom any check is to be sent. 5.6. The Affiliate is responsible for the payment of all tax and national insurance payable on any payments made to him by Goswac.com. 6. LIMITS ON GOSWAC.COM'S LIABILITY 6.1. Goswac.com cannot guarantee or warrant the performance of Goswac.com's service or the links to any linked web sites. 6.2. Goswac.com shall not be liable for costs and damages incurred by the Affiliate arising out of this Agreement unless caused directly by the negligence of Goswac.com in providing its service. Goswac.com shall not in any circumstances be liable for indirect or consequential damages and costs incurred by the Affiliate for any reason whatsoever. 6.3. Goswac.com will not be liable for defects in the service, interruptions in the accessibility to the service, infringements on data or loss of data on the information handling system, defects in the security system or viruses or other harmful software components in Goswac.com's service or for any damage caused by viruses or components to the service, the Affiliates software and/or the Affiliate's web site. Goswac.com shall not be liable for any error in the implementation of the links on the Affiliate's web site or for the specified function of the links. 6.4. Goswac.com shall not be liable if companies, which have registered Affiliate Programs at Goswac.com, do not fulfill their obligations according to their Affiliate Programs and Goswac.com shall not be liable in any way for any agreements made directly between the Affiliate and such companies. 7. TERM AND TERMINATION 7.1. This Agreement shall come into force upon your acceptance as an Affiliate and shall remain in effect until terminated. 7.2. The Affiliate is entitled to terminate this Agreement with immediate effect at any time. The Affiliate must cease to use the service immediately upon the termination of this Agreement and delete all links to Linked Web sites. 7.3. Goswac.com is entitled to terminate this Agreement and/or suspend the Affiliate from Goswac.com's service or from a certain company's Affiliate Program if: 7.3.1. Goswac.com considers the Affiliate or the content of his web site inappropriate in any way. 7.3.2. Goswac.com is requested to do so, for any reason, by a company to whose Affiliate Program the Affiliate is registered. 7.3.3. The Affiliate acts fraudulently or illegally in any way or the Affiliate generates or tries to generate Artificial Traffic to Linked Web sites or the Affiliate in any other way breaches any of the provisions of this Agreement. 7.3.4. The Affiliate has not generated any Traffic for a period of six (6) months. 7.4. Upon suspension of the Affiliate from a particular company's Affiliate Program, the Affiliate shall immediately delete all links to that particular company's web site. 7.5. Upon termination of this Agreement, Goswac.com shall inform the Affiliate immediately through Goswac.com's web site and/or via email and the Affiliate shall immediately cease to use the service and delete all links to Linked Web sites. 7.6. This Agreement expires immediately on termination and no remuneration will be paid to the Affiliate for the Affiliate Program or Programs in question. 8. INDEMNITY The Affiliate shall keep Goswac.com indemnified against any claims for damages or other claims for compensation arising from the contents of the Affiliate's web site or any incorrect information given to Goswac.com by the Affiliate. The Affiliate shall also compensate Goswac.com for any other damages or costs caused by the Affiliate's improper, negligent or unauthorized use of Goswac.com's service and technical problems or loss of data caused by the Affiliate on Goswac.com's web site or on any web site to which the Affiliate is linked by Goswac.com. 9. ASSIGNMENT OF THE AGREEMENT The Affiliate may not assign or pledge his rights or obligations under this Agreement in whole or in part to any third party without the prior written consent of Goswac.com. The Affiliate agrees that Goswac.com may assign its rights and obligations under this Agreement and divulge or transfer information about the Affiliate's web site, email etc to any third party. 10. CONSENT The Affiliate consents to the publication of the Affiliate's name and web address etc at Goswac.com's web site and to Goswac.com sending newsletters etc to the Affiliate's email address and using the information given by the Affiliate for marketing purposes. 11. SEVERABILITY If any provision of this Agreement or part thereof should to any extent be or become invalid or unenforceable, the parties shall agree upon any necessary amendment of the Agreement in order to achieve the interests and objectives of the parties prevailing at the time of execution of the Agreement. 12. INTELLECTUAL PROPERTY RIGHTS Goswac.com owns all copyrights, trademarks, intellectual property rights, know-how or any other rights connected to the service or software necessary for the service. The Affiliate does not acquire any rights or licenses whatsoever under this Agreement other than to use links to Linked Web sites on the terms of this Agreement. 13. APPLICABLE LAW 13.1. Goswac.com shall not be liable for the legality of Goswac.com's service in countries other than the United State. The Affiliate is solely responsible for the legality of the use of the service if the Affiliate is registered to Goswac.com's service from a country other than the United State or if the Affiliate's web site is on a server in a country other than the United States. 13.2. This Agreement shall be governed by, and construed in accordance with the laws of the State of Arizona USA. 13.3. If any dispute arises out of this Agreement any mediation or litigation, any legal fees will be the responsebiliy of the affiliate, and Goswac.com will not be held responsible to any legal fees arraise from a despute between the parties. 14. OTHER INFORMATION Agreement Created January 1st, 2004 and shall be valid until Goswac.com confirms termination. All changes/revisions/ammendments to the contract are valid from their inception date forward. This agreement may not be modified by the Affiliate. (END) This is our Affiliate Agreemet. Although it may sound strict, rest assured that we have nothing but good intentions towards our affiliates and customers. The contract is designed to maximize the efficiency and quality of our service for all customers.
